Formula Used
The average salary is based on the last 3 salaries received. The value of the installment is determined by progressive bands:
1. Average salary up to $2,041.39: Multiply the average by 0.8 (80%).
2. Average of 2.041,40 a 3,402.65: Whatever exceeds 2.041,39 é multiplicado por 0,5 (50%), somado a 1,633.10.

Practical Examples
Para um trabalhador com média salarial de $ 2,500.00 who requests the benefit for the first time after working 18 months:
- Excess value: 2.500,00 - 2,041.39 = $ 458.61
- Installment: 1.633,10 + ( 458.61 × 0.5) = $ 1,862.41 per month
- Quantity: 4 installments (worked between 12 and 23 months).

Is anyone who resigns entitled to Unemployment Insurance?
No. Unemployment insurance is an exclusive benefit for workers who were dismissed without just cause or in the case of indirect termination.
How can MEI (Individual Microentrepreneur) receive unemployment insurance?
The formally dismissed worker who has an active MEI will only receive unemployment insurance if he proves that the company does not earn income (zero revenue) and that the MEI activity is not used as his main source of support.
Is it possible to recover canceled or suspended unemployment insurance?
Yes, if the suspension occurred due to a new formal job and the worker is dismissed without just cause from this new position within the grace period. It is necessary to file an administrative appeal through the MTE/Gov.br portal.
What are the requirements to receive unemployment insurance?
To be entitled to unemployment insurance, the worker must: have been fired without just cause, not have another source of income sufficient to support themselves and their family, not be receiving another Social Security benefit (except accident benefit or death pension), and have worked for the following periods: 12 months in the first request; 9 months in the 2nd; 6 months in the 3rd and subsequent periods.
What is the deadline to request unemployment insurance after dismissal?
The worker must request unemployment insurance between the 7th and 120th day after the date of dismissal. The request can be made through the Digital Work Card application, on the gov.br/emprego portal, at SINE agencies or at Labor superintendencies. The necessary documentation includes personal documents, CTPS, Contract Termination Term (TRCT) and proof of the last 3 salaries.
Can unemployment insurance be suspended?
Yes. The benefit is automatically suspended if the worker: obtains a new formal job (with a formal contract), refuses without justification a compatible job offered by SINE, fails to attend free qualification courses recommended by the competent body, or has an application suspected of fraud. The resumption of the benefit depends on each situation and may require new proof of the situation.
Does unemployment insurance affect the calculation of the next future insurance?
Yes. The number of previous requests defines how many months of work are necessary to be entitled to the next insurance: the first request requires 12 months worked; in the 2nd, 9 months are required; in the 3rd onwards, only 6 months. This encourages retention in employment and discourages frequent dismissals. The request history is recorded in the Ministry of Labor system.
