What is the overtime allowance under the CLT?

Article 59 of the Consolidation of Labor Laws (CLT) establishes the following rules for mandatory minimum increases:

  • 50% on the normal hourly rate: for common overtime on working days (Monday to Friday).
  • 100% of the normal hourly rate: for overtime on Sundays and holidays (or according to the category's collective agreement).

Conventions and collective bargaining agreements may stipulate premiums higher than the legal minimums, so always check with your union.


How to Calculate the Normal Hourly Rate

The first step to calculating overtime is finding the exact value of your normal working hour. The calculation varies depending on the monthly journey:

For a 220-hour monthly shift (8h/day, 5 days/week):

Normal Hourly Rate = Gross Salary ÷ 220

For a 180-hour monthly shift (6h/day, 5 days/week):

Normal Hourly Rate = Gross Salary ÷ 180

Example: For a salary of $ 3.300,00 e jornada de 220 horas:

  • Hora Normal = $ 3,300 ÷ 220 = $ 15.00 per hour

Calculating Additional Overtime

Extra Common Time (additional 50%)

Overtime Value = Normal Time × 1.5

  • Example: $ 15,00 × 1,5 = $ 22.50 per overtime

Overtime on Sunday or Holiday (additional 100%)

Overtime Value = Normal Time × 2.0

  • Example: $ 15,00 × 2,0 = $ 30.00 per hour overtime on holidays

The Reflection of Overtime on DSR

DSR (Remunerated Weekly Rest) is the right to paid rest of at least 24 consecutive hours per week (generally Sunday). The CLT determines that the value of overtime is part of the DSR calculation basis in the month in which it is carried out.

How to calculate DSR:

  1. Add up the total amount of overtime worked during the month (excluding those on Sundays and holidays, which have already paid DSR).
  2. Divide this amount by the number of working days worked in the month.
  3. Multiply the result by the number of Sundays (or midweek holidays) in the month.

Overtime and Other Labor Charges

The overtime premium is not an isolated payment. The total amount (including the additional fee) reflects other charges that the employer must calculate:

  • FGTS: The FGTS of 8% is applied to total overtime paid.
  • INSS: The contribution to INSS is calculated on the total amount of remuneration (salary + overtime + DSR).
  • 13th Salary and Holidays: The usual overtime is part of the calculation basis for the 13th salary and holidays.
