How to Calculate Additional Night Work (CLT 2026 Rules)

Night Additional is a labor right guaranteed by the Federal Constitution and regulated by article 73 of the Consolidation of Labor Laws (CLT). It compensates for the physical and social strain on employees who work at night.

Understanding the calculation is essential both for the worker to check their payslip and for the HR sector to carry out the payroll without errors.

1. Who is entitled to the Night Additional?

Any urban worker hired under the CLT who carries out his activities at night — between 10 pm on one day and 5 am on the following day.

• Urban Minimum Additional: 20% of the daytime hourly rate.
• Rural Worker (Farming): Work from 9pm to 5am with a minimum additional of 25%.
• Livestock Worker: Work from 8pm to 4am with a minimum additional payment of 25%.

2. The Golden Rule: Short Night Time (52m30s)

The CLT establishes that urban night working hours are not 60 minutes, but rather 52 minutes and 30 seconds (Art. 73 § 1).

This means that 7 clock hours worked between 10pm and 5am correspond to 8 hours of work computed on the pay slip (multiplication factor of 1.1428 or 8/7).

3. Step by Step Calculation

1. Find out the normal hourly rate:

2. Calculate the additional value per hour (20%):
   $Adicional\ por\ Hora = Valor\ da\ Hora \times 0,20$

3. Convert night clock hours to computed hours:
   $Horas\ Computadas = Horas\ Relógio \times 1,142857$

4. Calculate the total amount of the additional for the month:
   $Total\ Adicional = Horas\ Computadas \times Adicional\ por\ Hora$

4. Practical Calculation Example

Imagine an employee with a salary of $ 2,200.00 for a 220-hour shift per month, who worked 40 hours at night during the month:

• Normal Daytime Hours: $ 2.200 / 220 = $ 10.00 per hour.
• Night Additional (20%): $ 10,00 x 0,20 = $ 2.00 per hour.
• Computed Night Hours: 40h x 1.142857 = 45.71 hours.
• Night Additional Value: 45.71h x $ 2,00 = $ 91.42.
• Total Payment for Night Hours: 45.71h x $ 12,00 = $ 548.52.
